Can a non-alcoholic food license holder sell fruit beer in India?

FSSAI Registration is used for Food safety and grant permission to any individual to carry on food business in any parts of India. To start any food business, one should register in FSSAI Portal and get the FSSAI license. The food license is specific to a particular location and also term bound.

 

The Food Safety and Standards Authority of India (FSSAI), established in 2006, handles all the food related issues in various Ministries and Departments. FSSAI License is mandatory for all the Food Business Operators. Though headquarters at New Delhi, FSSAI authority has six regional offices in Delhi, Kolkata, Guwahati, Chennai, Cochin, Mumbai. The following structures are incorporated under the act:

  1. Food Manufactures
  2. Online food sellers
  3. Hotel caterers
  4. Food packaging and cold storage units.
  5. Wholesale food sellers.

FSSAI License is regarded as one of the most important licenses from all other license that are needed to run a Bar successfully without getting tied up in any legal problems. It is of utmost importance and also compulsory for each and every owner of the Bar to get the FSSAL License for their Bar from the State Authority or from the Central Licensing authority depends upon income.

Any type of restaurants that likes to serve alcoholic drinks in India needs an appropriate Liquor license. For applying this license, the FBO must contact their Local Excise Commissioner. Liquor laws vary from state to state the FBO should visit their state’s official Excise website. Opening and operating a Bar without this license can cause heavy penalty and a shutdown of their business.

The mandatory documents needed to apply for selling alcoholic drinks in India are as follows:

  1. Business registration or incorporation certificate.
  2. Proof of address of the business premises.
  3. Completion certificate of the bar or restaurant.
  4. Trade license.
  5. Eating house license registration from the DCP.
  6. GST Registration.
  7. NOC from the State Fire Department.
  8. Affidavit ensuring the applicant has no outstanding dues o criminal history.

In few states, there is a fixed yearly licensing fee depending on the location of their restaurant. Top cities have a yearly licensing fee of INR 10 Lakhs, on the other hand 4 tier cities have a fee worth INR 2.5 Lakhs. While, on the other states one need to pay a processing fee of INR 5,000 after the documents get submitted.
